Terms of Service
These terms are the deal between you and us when you use Standwell Web. We have tried to write them the way we would explain them across a counter. Please read them; by creating an account or using the service you agree to them.
1. Who we are
Standwell Web is run by Standwell Web, LLC (“Standwell Web”, “we”, “us”), a Colorado limited liability company. You can reach us through the contact form or at [email protected].
Standwell Web lets small businesses build and run a simple shop website (“shop”) with listings, photos and their own words, on a Standwell web address or on a name they already own.
2. Your account
Who can use it. Standwell Web is for businesses and personal projects, like a student’s side hustle, a club, or a hobby. You must be 18 to open an account and pay. Teens 13 to 17 can build and run a site with a parent or guardian who opens the account, agrees to these terms, and is responsible for it. We don’t knowingly collect personal data from children under 13. If you think a child under 13 has given us their details, contact us. We’ll look into it promptly, and if it’s true, we’ll delete them.
- Give us an email address that works and keep your password to yourself. You are responsible for what happens under your login.
- One login can hold up to 5 shops. If you need more, contact us.
- You may try the editor without an account. Guest tries that are not saved to an account are removed after about a week of no use.
3. Your shops and content
Your words, photos, prices and listings (“your content”) stay yours. You give us permission to store, copy, resize and show your content only as needed to run your shop, keep backups, and provide the service. That permission ends when your content is deleted, except for copies in backups until they roll off (see the Privacy Policy).
You are responsible for your content and for the business you run through your shop, including the accuracy of your prices and listings, the goods and services you sell, any licences or permits you need, and how you deal with your own customers. Standwell Web is not a party to sales between you and your customers.
You confirm you have the rights to everything you upload, including photos of people and other people’s work. Our own designs, layouts, sample pictures and software stay ours; you may use them in your shop while your account is open.
Uploaded photos have their camera details and location data removed when we save them.
You can download your photos and words at any time from Your shops: the pictures you uploaded and your text (business name, descriptions, listings, prices, hours and contact details) in plain, readable files, plus the licenses of the fonts our editor offers. The templates, layouts, styles, template pictures and page code (HTML, CSS and JavaScript) belong to Standwell Web, LLC and are not included. Stock photos from our picture library are listed with links to their source instead of being copied, because their license does not let us pass on the files.
Find a shop near you. Our shop directory is opt-in and free. If you tick the box for a shop in Your shops, we may show that shop’s name, town, state, category and link in the directory while the shop is online. You can opt out any time by unticking it.
4. Prices and billing
Trying Standwell Web is free. A shop is billed only while its live site is on.
| What | Monthly | Every 3 months | Every 6 months | Yearly |
|---|---|---|---|---|
| Shop with one page | $4.99 a month | $14 every 3 months | $27 every 6 months | $49 a year |
| Shop with two pages | $9.99 a month | $28 every 3 months | $54 every 6 months | $99 a year |
| Use your own domain: a domain you own, connected to a shop (add-on) | $1 a month | $3 every 3 months | $6 every 6 months | $12 a year |
| Remove the “Made with Standwell Web” link from a shop (add-on) | $2 a month | $6 every 3 months | $12 every 6 months | $24 a year |
The terms you can choose for a shop are the ones shown when you pay. An add-on is always billed on its plan’s term, at the price in that column. An add-on is available only while we offer it: if Your shops or the payment page does not show it, it is not available right now.
Add-ons. Using your own domain and removing the Standwell link are add-ons. An add-on is not a plan of its own: it is added to that shop’s plan, is billed on the same bill and the same term (monthly, every 3 months, every 6 months or yearly) as the plan, and ends when the plan ends, for any reason. Paying for an add-on never keeps a shop online by itself, and it does not pay for any time beyond the date the shop’s plan is paid through. If you start an add-on part-way through a paid period, you pay once for the days left until the plan’s next bill (we show the amount before you pay), and after that it is on each bill of the plan. If you stop an add-on, it stays on until the date already paid, then stops and is not billed again. No refunds for days already paid.
The Standwell link. Shops on these plans show a small “Made with Standwell Web” link at the bottom of the page. You can remove it from a shop as an add-on: $2 a month on a monthly plan, $6 every 3 months on a 3-month plan, $12 every 6 months on a 6-month plan, or $24 a year on a yearly plan, billed with the plan. If you stop it, or the plan ends, the link stays hidden until the date already paid for, then shows again. Custom builds do not show the link unless we agree to it in the quote.
Prices are in US dollars. Prices do not include sales tax, and we do not charge sales tax right now. Each state sets its own rules, and many only require a seller like us to collect tax once our sales in that state pass a certain amount. If a state’s law requires us to collect it, we will add it as a separate line on your bill and tell you at least 30 days before it starts. Any tax we collect goes to that state, not to us. You pay by card, or a card wallet like Apple Pay or Google Pay. Payments are handled by our payment processor, Stripe; we never see or keep your full card number.
- Automatic renewal. Every plan here is a subscription that renews automatically and charges your card at the price shown when you paid: monthly plans every month, 3-month plans every 3 months, 6-month plans every 6 months, yearly plans every year, and the own-domain and link add-ons with their plan, on the same term. It keeps renewing until you cancel. Each renewal is for the same length as before, never longer than a year. There is no minimum term.
- How to cancel. Online, any time, in Your shops: press Cancel (turn the live site off), or stop an add-on there. Cancel before the renewal date and you will not be charged again. You do not need to call or email us.
- Turning live off (canceling). Canceling stops the next renewal; it does not end what you already paid for. Your site, and any add-ons on its plan, stay live until the end of the time you paid for (the paid-through date in Your shops), then stop. There is no cancellation fee. Your shop and login are kept, so you can turn it back on later; turning it back on starts billing again.
- Refunds. No refunds for unused time, on any term (monthly, every 3 months, every 6 months or yearly), and that includes add-ons. We do not refund days already paid, whether you turn live off, stop an add-on, downgrade, delete a shop, or delete your account, except where the law requires it or as these terms say (see section 9). If you think you were charged by mistake, contact us and we will look into it.
- Upgrading from one page to two. You pay the difference for the days left in your current period. If that difference is under 50¢, the upgrade is free.
- Downgrading from two pages to one. Takes effect right away. There is no refund for the rest of the period.
- Switching terms (monthly, every 3 months, every 6 months, yearly). If no card plan is running for the shop, the new choice is used for its next payment. Once a card plan is running, turn the shop’s live site off and pay by the new term when the paid period ends; we do not switch it mid-plan, because that would charge you early.
- Price changes. We will tell you at least 30 days before a price change affects you. It applies from your next bill after that notice.
- Failed payments. If a renewal payment fails, your shop stays up until the end of the period you already paid for, and Your shops shows a note so you can update your card with “Manage card”. Our payment processor, Stripe, tries the card again automatically a few more times over the following days and weeks, using its standard retry schedule. If a retry goes through, the shop carries on as normal. If the period ends before a payment goes through, the shop stays up for up to 3 more days while Stripe tries; after that its live site closes until it is paid; your shop and login are kept, and paying from Your shops opens it again. If every retry fails, the card plan may be stopped, and you can start it again from Your shops.
5. Use your own domain
When we offer it (Your shops and the payment page show it), you can connect a domain (web address) you already own to a shop as an add-on, “Use your own domain”: $1 a month on a monthly plan, $3 every 3 months on a 3-month plan, $6 every 6 months on a 6-month plan, or $12 a year on a yearly plan, billed with the plan. You buy and renew the domain yourself at a registrar you choose; that registrar’s terms and fees apply and are between you and them. We do not register, transfer or renew domains for you. Removing your domain, turning the shop’s live site off, or deleting your account stops your domain from showing your shop. The domain itself stays yours at your registrar.
To check a name, we look up its public DNS records. If you point a name at us that you do not control, we may disconnect it.
6. Custom work
Design or build work beyond the standard shop is quoted separately, in writing, before we start. Those quotes have their own price and terms, and these terms apply where the quote is silent. A custom build does not show the “Made with Standwell Web” link unless the quote says it does.
7. Content rules
Your shop must follow our Acceptable Use and Content Policy. If a public shop breaks it, we may pause the shop so visitors cannot see it, and we will tell you why and how to fix it where we can. While a shop is paused its billing period keeps running.
Copyright and repeat infringers. Copyright complaints are handled as set out in section 6 of the content policy. We keep a record of valid copyright notices, and we close the accounts of people who repeatedly infringe.
8. Example and sample sites
To show what a shop can look like, Standwell Web includes example shops and sample businesses, such as the examples linked from our front page, the templates, and the “Try a business” starters in the builder. These businesses are made up. Their names, photos, prices, addresses, phone numbers and other details are fictional and are only there to show the layout. They do not stand for, describe or endorse any real business or person, and any resemblance to a real business is coincidental. If you think an example looks too much like your real business, email us and we will change it.
9. Ending
You can delete your account at any time from Your shops. That takes every shop offline right away, stops your own domains and future bills, and does not refund days already paid. You can download your photos and words first.
We may suspend or close an account, or pause or remove a shop, if you seriously or repeatedly break these terms or the content policy, if the law requires it, or if your use puts the service or other people at risk. Where it is reasonable, we will warn you first and give you a chance to fix things and to download your photos and words. If we stop offering Standwell Web entirely, we will give at least 30 days notice and refund any unused prepaid time.
10. No warranty
We work hard to keep shops fast and online, but the service is provided “as is” and “as available”. To the fullest extent the law allows, we make no warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not promise the service will be uninterrupted or error-free. Keep your own copies of anything important; you can download your photos and words at any time.
11. Limits on liability
To the fullest extent the law allows, Standwell Web and the people who run it will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the service. Our total liability for any claim about the service is limited to the amount you paid us in the 12 months before the claim, or $50, whichever is more.
You agree to cover us for claims by others that come from your content, your shop, or your business, including your dealings with your own customers. This includes reasonable legal fees and costs, and any fines or damages we are made to pay because of what you posted or sold. Some places do not allow some of these limits, so they may not all apply to you.
12. Law and disputes
These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-law rules. Disputes will be handled in the state or federal courts located in Weld County, Colorado, and both of us agree to that venue. Before going to court, please email us at [email protected]; most things can be sorted out quickly. Either of us may also use small claims court if the claim qualifies.
13. Changes to these terms
We may update these terms. If a change matters, we will tell you by email or in the app at least 30 days before it takes effect. If you keep using the service after that, the new terms apply. If you do not agree, you can turn live off or delete your account.
